Jack Presenta Sweeps Terms & Conditions
NO PURCHASE NECESSARY. You must be at least 21 years of age and a legal resident of the United States, residing in New York City to participate. Sweepstakes void where prohibited or restricted by law.
SPONSOR: Brown-Forman, 850 Dixie Highway, Louisville, KY 40210 and its Jack Daniel’s brand (“Brand”) (collectively, “Sponsor” or “Brown-Forman”) is solely responsible for all aspects of this sweepstakes.
SWEEPSTAKES: “Jack Presenta x Musicians on Musicians Latino Sweepstakes”. One (1) prize winner and one (1) guest will be eligible to attend an event in connection with Musicians on Musicians Latino, a collaboration between Jack Daniel’s and Rolling Stone, at a location in New York City provided upon winner verification (the “event”) (collectively, the “Sweepstakes”). Tickets to the event, to be provided by Rolling Stone (“Prize Provider”). For purposes of clarity, all travel to be booked and provided by Sponsor.
SWEEPSTAKES PERIOD: “Jack Presenta x Musicians on Musicians Latino Sweepstakes”. The Sweepstakes starts on February 8, 2024, at 12:00 a.m. EST and ends on February 28, 2024 11:59 p.m. EST (“Sweepstakes Period”).
HOW TO ENTER: To enter via wireless text messaging, during the Sweepstakes Period, send the letters JACKPRESENTA to 68405 from your 2-way text messaging capable wireless phone. Once you send the text message, you will receive a link to the Sweepstakes entry form. You must fill out the form provided by the link to be entered into the Sweepstakes. Entrants will be charged their standard text messaging rate for each text message sent or received through their handset according to the terms of their wireless calling plan. Text messaging and wireless services are not available in all areas.
Alternatively, you may enter by going to https://www.jackdaniels.com/en-us/jackpresenta and completing and submitting the online form found there. Limit one (1) entry per day, per person, regardless of method of entry.
All entries must be received on or before February 28, 2024 11:59 p.m. SDT.
ELIGIBILITY: Employees of Brown-Forman, Prize Provider, and their affiliates, as well as the advertising/ promotion agency, and the immediate families and household members of each are not eligible to win. Holders of wholesale or retail licenses are not eligible. You must be at least 21 years of age and a legal resident of the United States, residing in New York City.
DRAWING: Prize winner(s) (the “Winner(s)” or “Potential Winner(s)”, as applicable) will be selected in random drawing(s) from among all timely received eligible entries. Odds of winning depend on the number of eligible entries received. Drawing will be conducted on or about March 1, 2024.
PRIZES: There will be one (1) Grand Prize awarded:
Grand Prize consists of two (2) VIP tickets to the Musicians on Musicians NYC event during the first week of March 2024 (specific dates and duration of stay to be determined). Ground transportation, gratuities, incidentals, upgrades, service charges, food, beverages, merchandise or any other expenses not specified herein are not included and are Winner’s sole responsibility. Approximate retail value (“ARV”) of Grand Prize prize is $120.00 value in dollars. The Grand Prize will be sent to the Winner either digitally or by mail.
Beverage alcohol is not part of the sweepstakes prize. All federal, state and local taxes on Grand Prize is the sole responsibility of Grand Prize Winner. No substitution or transfer of Grand Prize offered or permitted. No transfer of Grand Prize to a third party is permitted and Grand Prize cannot be redeemed for cash value, except by Brown-Forman, who reserves the right in its sole discretion to substitute Grand Prize or a portion of the Grand Prize for a prize of comparable or greater value. Limit one (1) Grand Prize per person/household. The Potential Winner(s) will be notified via the contact information provided at time of entry. Winner (and guest) must be at least 21 years of age. Unclaimed Grand Prize may not be awarded. All fees, federal, state, and/or other expenses relating to the use, acceptance and possession of Grand Prize are the sole responsibility of Winner. Taxes are the responsibility of Winner.
Certain restrictions may apply. Winner acknowledges that the Concert is beyond the control of Sponsor and Prize Provider and is subject to being rescheduled, modified or canceled. If the event is postponed, canceled or has not occurred, no compensation or substitution for the event will be provided. Winner and guest must comply with any security procedures or measures imposed by the event’s personnel and/or its representative(s). Sponsor, Prize Provider and/or event’s personnel/representative(s) each reserve the right in their sole discretion to suspend or cancel Winner’s and/or their guest’s attendance at event due to non-compliance with any security procedure, venue requirements or inappropriate behavior or misconduct. Grand Prize Winner and guest are responsible for obtaining proper documentation (i.e., valid government issued photo identification, passport and/or visa). Winner’s guest must be 21 years of age or older. Arrangements for the fulfillment of Grand Prize will be made by Sponsor and/or its designated agents.
NOTICE: Potential Winner will be notified on or after March 1, 2024. Potential Winner will have two (2) days from the date of notice (“Designated Period”) to accept the Grand Prize and execute and return an Affidavit of Eligibility / Liability / Publicity Release (“Affidavit/Release”) or any other required documents as determined by the Sponsor or Sponsor’s agent (unless prohibited by law) or Potential Winner will be disqualified. If a Potential Winner does not accept the prize within the Designated Period, he/she may forfeit the prize and an alternate winner(s) may be selected. Alternate winner(s) may have a varying time to accept the prize(s), however, in no way shall a Potential Winner have greater the Designated Period in which to accept the Grand Prize. Guest of Winner may be required to sign a similar release.
Brown-Forman and participating promotional companies, including, but not limited to, Prize Provider, are not in any way liable for damage, loss or injury resulting from computer malfunctions, misdirected or incomplete entries or acceptance and use of the Grand Prize. Brown-Forman reserves the right in its sole discretion, to cancel or suspend this Sweepstakes should virus(es), bugs or other causes beyond the control of Brown-Forman corrupt the administration, security or proper play of the Sweepstakes. Brown-Forman reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate or suspend the Sweepstakes. Brown-Forman, nor Prize Provider, assumes any responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft or destruction or unauthorized access to, or alteration of, entries.
In all applicable territories to the fullest extent possible in law, entrants to the Sweepstakes and Potential Winner(s) (including, without limitation, Winner(s)), and on behalf of their respective, heirs, executors, administrators, legal representatives, successors and assigns (the “Releasing Parties”), release, defend and hold harmless Prize Provider and Brown-Forman from any and all actions, causes of action, suits, debts, dues, sums of money, accounts, reckonings, bonds, bills, specialties, covenants, contracts, controversies, agreements, promises, variances, trespasses, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, judgments, executions, claims and demands whatsoever, in law, admiralty, equity, whether known or unknown, foreseen or unforeseen, against Prize Provider and Brown-Forman which any one or more of the Releasing Parties ever had, now have or hereafter can, shall or may have, which in any way arise out of or result from a participant’s/entrant’s participation, acceptance and use or misuse of a Grand Prize or any portion of the Grand Prize, including property damage, personal injury or death.
GENERAL: By entering the Sweepstakes, each entrant affirms that they have read, understands and accepted these Rules. Any information collected by entering the Contest shall be used only in a manner consistent with these Rules and Brown-Forman privacy policy.
CAUTION: Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, Brown-Forman/Brand reserves the right to seek damages from any such attempt. Brown-Forman/Brand reserves the right to seek damages from any such entrant to the fullest extent of the law.
By accepting his or her prize(s), the Winner(s): (a) releases Brown-Forman, Prize Provider, and their affiliated companies and licensed alcohol wholesalers and retailers from any all liability claims, action or proceedings arising out of or for injuries or damages sustained while involved in a promotion activity or connection with the use of the prizes; as well as (b) consents to the use by Brown-Forman for promotional and advertising purposes in connection with this promotion and general use of the images submitted with entries, of his or her name and/or likeness and/or voice without further compensation. Proof of identification and age verification will be required. Any traveling companion of the winner(s) must be at least 21 years of age and will also be required to sign a similar release. Further, the Winner(s) releases Prize Provider and its affiliates, licensees, officers, directors and employees from any and all liability claims, actions, or proceedings arising out of or in connection with injuries or damages sustained while involved with or in connection to the use of the Grand Prize(s).
PRIVACY: Except as otherwise contemplated in these Official Rules, your contact information and any other information submitted by you, or collected by Brown-Forman, in connection with this sweepstakes will be used in accordance with the Brown-Forman’s privacy policy (https://legal.brown-forman.com/privacy-policy/english).
In all applicable territories, Brown-Forman and Prize Provider are not responsible for any suspension of the Sweepstakes or inability to implement the Sweepstakes or award any prize as contemplated herein due to any event beyond their control, including delays or interruptions caused by acts of God, acts of war, natural disasters, pandemic, weather, utility outages, acts of terrorism or any federal, state, or local government law, order, or regulation, order of any court or regulator. This Sweepstakes shall be governed by and interpreted under the laws of Commonwealth of Kentucky, without regard to its conflicts of laws provisions. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action or mandatory local law provisions outside of Kentucky law provisions as per the stated governing law may apply. This choice of law does not deprive entrants of the protection afforded to them under their own laws and such provisions that cannot be derogated from by agreement by virtue of the law of the entrant’s own jurisdiction
